Concerning SAN MAI®
Cold Steel owns three US trademark registrations that contain the words “San Mai.”
The trademark registration numbers are: 1471971, 3540202 & 3540187.
You can view them by visiting the US Trademark Office Database, here: http://www.uspto.gov/trademark
Cold Steel first used SAN MAI® in 1986, then further expanded upon this trademark in 2008, taking an obscure Japanese term and applying it to our 3-layered steel right here in the United States.
We then began promoting and raising public awareness of this name and our products – something that continues through to this very day.
From our earliest days doing live demos showing our knives passing the grueling tests set by the American Bladesmith’s Society®, to our modern PROOF video content on the internet, we have invested millions of dollars promoting our trademark to an international audience.
Thanks to our continued promotion and investment, SAN MAI® became a well-known brand. The U.S. Trademark Office recognized SAN MAI® as a distinctive trademark associated with Cold Steel knives in 2008, and then recognized it as incontestable in 2014.
In order to retain this long-standing trademark, we are required by law to make an attempt to defend it. Ever since the 1980s, we have been contacting knife companies, manufacturers and makers asking them to refrain from using our trademarked name.
Recently our company President once again sent out polite and courteous letters asking people to kindly respect our 30+ year trademark.
The letter can be read below:
=====================
* Dear _______________:
I am writing to advise you that your use of the term SAN MAI in ________________ infringes on the trademark rights of Cold Steel, Inc. (Cold Steel).
I understand that you may not have been aware of this trademark or of Cold Steel’s long-standing use of the name SAN MAI. Therefore, I ask that you refrain from using the term SAN MAI to refer to any knife, layered steel or related products, except in regard to the products sold by Cold Steel, Inc.
Cold Steel owns the U.S. trademark registrations referenced above and has used the trademarks SAN MAI® and SAN MAI III® in connection with knives and layered steel since at least 1986. Cold Steel owns the exclusive right to use these terms in connection with those products.
I ask that you discontinue the use of the words SAN MAI and any confusingly similar trademark, and remove any references to SAN MAI from any websites and Social Media pages within 10 days from receipt of this letter. Please also remove any references to SAN MAI in printed materials before the next print edition or version of those materials is released.
I also kindly ask that you post a retraction online regarding this error, ensuring that there is no further misunderstanding within your client or fan community. Please acknowledge receipt of this letter, and advise my team of the steps you will take to help remedy this situation.
Thank you
Regards
Lynn C Thompson
President
Cold Steel, Inc.
==============
We have invested millions of dollars for over three decades spreading the word about SAN MAI® through catalogs, DVDs, live demonstrations, online videos and of course through the sale of our products. It is vitally important to us that we continue to defend our investment.
No threats have been made, and no action has been taken at this time, but we do kindly ask that people respect our trademark.
Thank you for your understanding
